Leave Policy and Information

Albemarle County offers various types of paid leave to eligible employees:

  • All 12-month regular employees get 12 paid holidays each fiscal year.  Additional holidays may be added at the discretion of the Boards.

  • The purpose of Sick Leave is to provide paid time in the event of absences due to personal illness and/or illness or death in the family.  All benefits-eligible employees will earn Sick Leave days at the rate of one (1) day per month of employment (regular,full time) or a major fraction thereof (regular,part-time) with no maximum on accumulation.

  • This applies to benefits-eligible 10/11 month Teachers and Classified Staff, and 11-month Administrative Staff.  For more specific information click on the "Leave Policy (School)" link under the Leave Links section on the right.
  • An employee must notify the Principal/Department Head at least five (5) days in advance of the day or days to be taken as personal leave, in order that a suitable replacement may be secured for that position.  If it is necessary for an employee to request personal leave without five (5) days notice, the Principal/Department Head may require an explanation from the employee.
  • Guidelines for granting personal leave for eligible personnel are as follows: 
    • Personal leave may not be taken during the first ten (10) teaching days and/or the last five (5) contract days, including snow makeup days at the end of the school year.
    • Personal leave may be used provided it does not immediately precede or follow a school holiday or another leave, including compensatory leave. A school holiday is defined as a time when schools are closed for students and teachers exclusive of normal weekends.
    • The Principal/Department Head may limit the number of employees who may be granted personal leave on a given day in order to assure the orderly and efficient operation of the school/department. 
    • Personal leave may not be granted to an employee who has not met expectations for attendance during the current and/or previous school year.
       
    Exceptions to these guidelines may be granted with approval by the Principal/Department Head. A written request from the employee for an exception must be made to the Principal/Department Head. The decision of the Principal/Department Head may be appealed to the Superintendent/Designee.
     
    Under special circumstances, a Principal/Department Head may authorize two (2) days of noncumulative, unpaid personal leave each year. The Superintendent/Designee may extend the unpaid personal leave to five (5) consecutive days for emergencies or circumstances that, in the judgement of the Superintendent/Designee, deserve special consideration.

  • Employees may be permitted to use up to five (5) days of accrued Sick Leave in the event of the death of a member of the employee's immediate family. Any additional time required by the employee in such event shall be covered by Annual Leave, Compensatory Time or Unpaid Leave, as may be applicable.  In the event of the death of a non-immediate family member, employees will be required to use Annual Leave, Compensatory time or Unpaid Leave, as may be applicable.

  • When hiring licensed personnel, Albemarle County Public Schools accepts a maximum of ninety (90) sick days which have been accumulated by that employee while serving as a teacher or administrator in another school division within the Commonwealth of Virginia.

(this effectively acts as another form of Short Term Disability for the County)
  • The Sick Leave Bank offers up to 45 days paid leave to eligible members and is designed to help employees through an extended illness when he or she has no remaining sick leave balance.  The employee must meet the first 20 days of their illness with whatever leave they have available (sick, annual, comp, unpaid) and exhaust all of their available sick leave before having access to the Bank.
  • Employees may enroll in the Sick Bank within 30 days of hire or during Open Enrollment.  Current employees who enroll during the open enrollment period must also submit medical documentation for proof of good health.

  • All 12-month benefits-eligible regular employees of the County shall be granted annual leave by the County.  Accrual of days of annual leave is based on duration of employment for the County.  Please view the "Annual Leave Policy" link under the Leave Links section on the right side of the page for more information.
  • Annual Leave Payout - when a 12-month employee leaves, the department will pay this out up to the maximum.  For more information review the "Annual Leave Policy (Local Gov)" and/or the "Leave Policy (School)".  Links are located under the Leave Links section on the right.

Family Medical Leave (FML) provides up to 12 weeks of unpaid job protected leave to eligible employees for the following reasons:
 
  • Due to pregnancy, prenatal medical care, child birth, foster care placement or adoption
  • Paid leave will be used in conjunction with FMLA
  • To care for the employee's spouse, child, or parent who has a serious health condition
  • For a serious health condition that makes the employee unable to perform his/her job
  • For employees who have a spouse, child, or parent on active duty or called to active duty for certain qualifying exigencies
  • For employees to care for a covered service member for a serious injury or illness (up to 26 weeks of leave)

  • To use the military leave benefit, you must present your orders to your department and code this leave as military leave for up to 15 days per federal fiscal year.  For more than 15 days, a leave earnings statement is required. For more information, please consult the "Military Leave Policy" under the Leave Links section.

Short Term Disability(for Hybrid VRS Members)
  • Short-Term Disability is benefit offered to all participating Hybrid Retirement Plan Members (employees hired on or after January 1, 2014 with no prior VRS service). The qualifying periods for coverage is one-year waiting period for non-work related claims and first day benefit for work-related claims. The short-term disability benefit duration is 125 paid workdays. If your claim is approved, the benefit will begin on the eighth calendar day of your disability. If you work 20 hours or less during the first seven days of your disability, you will have satisfied the elimination period. To initiate a claim, please contact Human Resources.

(through The Hartford)
  • Long Term Disability LTD coverage is offered through The Hartford. (Note: This LTD insurance is optional and separate from the LTD benefits provided to VRS Hybrid members.) LTD insurance pays a portion of your earnings if you cannot work because of a disabling illness or injury and is a recommended component of your current benefits elections.
  • LTD through The Hartford is voluntary, employee-paid coverage that features low group rate premiums paid through the convenience of monthly payroll deduction. If you enroll during the first thirty (30) days of hire, enrollment is guaranteed (normal waiting periods apply) and no medical information will be required. Employees who do not enroll during their initial eligibility period will have the opportunity to enroll during the annual benefits Open Enrollment period, but will have to complete a medical questionnaire along with their enrollments. Coverage is not guaranteed once outside of the initial offer period.
(LTD for Hybrid VRS Members) 
  • Long Term Disability LTD coverage is a benefit offered to all particpating Hybrid VRS Members who are out for more than 125 days (waiting period).

  • Leave without Pay (LWOP) (short-term): There may be times when employees are unable to work and do not have paid leave available to them. The Principal/Department Head/Designee may give consideration to short-term leave without pay requests. These requests are generally for less than 3 weeks. Benefits may be affected.
  • Leave of Absence (LOA) - a.k.a. Leave Without Pay (long-term): There may be times when employees are unable to work and do not have paid leave available to them. The Principal/Department Head/Designee may give consideration to long-term leave without pay requests. These requests are generally for more than 4 weeks. Benefits will be affected.
  • Requests must be in writing to the Principal/Department Head/Designee (for both LWOP and LOA)

  •  Comp time is only applicable to non-exempt employees who are scheduled to work at least 40 hours a week.
  •  Earning comp time in lieu of overtime pay must be pre-approved by your supervisor.
